Take Mix To Work and Win Official Rules

Promotion Dates: January 1-December 31, 2008

1) A copy of these rules will be available for public inspection during normal business hours at the KMXZ business office, 3438 N Country Club Road., Tucson, AZ 85716, Monday through Friday.

2) The execution of this promotion is as follows: NO PURCHASE NECESSARY. Three times per day every weekday during the promotion period, KMXZ will randomly select the name of a person, also known as “contestant”, from mailing lists, listener database, phone book, mailed entries, faxes and e-mails received at the station. KMXZ will then announce the contestant’s name on the radio. These announcements will occur at the beginning of each of the following hours: 9am, 2pm, and 5pm. The name announcement will be as close to those times as possible, but may not be precisely at the top of the hour due to song scheduling. Once a contestant’s name is announced, that person must call KMXZ at 880-0949 within 10 minutes. If the contestant succeeds in calling the station within 10 minutes, and can establish identity by answering certain questions (such as contestant’s address and phone number), and otherwise meets all criteria as defined in these official rules, that person will win $100. For April – May, listeners will be eligible to win $1000 on Thursdays. Contestant’s name will be revealed only once, and only on the radio at 9am, 2pm or 5pm. The on-air personality, receptionist, promotions person or any other Journal Broadcast Group employee cannot and will not repeat the name at any time, either on or off the air. Listeners and contestants who miss the announcement of the name will not be able to learn it by contacting KMXZ or any of its employees. Announcement time and the 10-minute countdown time will be based on station studio clock. 10-minute time limit begins when contestant’s name is announced live over the air, and not the time when the name may be heard via our streaming Internet audio. Significant and unpredictable time delays are inherent in streaming Internet audio; therefore, only live broadcast time will apply. Decisions of KMXZ are final.

3) Employees and ex-employees of Journal Broadcast Group, Inc. (KMXZ), promotion sponsors, their advertising agencies, parent companies, subsidiaries, and members of their immediate families are not eligible to participate in the contest. Members of competing media and their immediate family are also ineligible. Void where prohibited by law.

4) By calling, faxing or otherwise communicating with KMXZ to participate in “Take Mix To Work and Win” contest, participants hereby grant KMXZ and its licensees the right to use participants name, likeness, portrait, live or recorded voice and biographical material in order to advertise, promote or publicize KMXZ, its products and any advertisers on KMXZ. KMXZ is not responsible for any lost e-mail, mail, misdirected or lost/dropped phone calls or faxes due to mechanical, cell phone, human error, or incomplete faxes or e-mail.

5) Winners will release and discharge Journal Broadcast Group Inc. (KMXZ), promotion sponsors, and their officers and employees from any liability for any injuries or damages or causes of action arising out of, or in connection with said contest or attendant to the acceptance and use of the prizes won. Prior to acceptance of prize, winner will be required to sign an affidavit of eligibility, a release form, and show proper I.D. certifying compliance with official rules. Winner must be 18 years of age and must be a legal resident of the United States.

6) Journal Broadcast Group (KMXZ) reserves the right to modify or enhance these rules at any time.

7) Prize is non-transferable. Winner is responsible for all taxes.

8) Contest will end on December 31, 2008. Only one winner per household. Contestants who “Take Mix to Work and Win” cannot win any additional prizes from KMXZ or any Journal Broadcast Group station for 30 days.
